As we already covered, Justice Scalia keeled over for good this weekend, which leaves an empty seat on the SCOTUS. It is ultimately up to the President of the United States to appoint the next Supreme Court Justice to a lifetime term. However as the NFN highlighted, Congress has some constitutional authority in terms of being able to influence and ultimately approve the POTUS’s appointment.
Over the next few weeks, you’ll hear a bunch of fuckface gasbags (media personalities) in the MSM pontificate about how it is so absurd, barbarian, and unconstitutional for Republicans to declare that Obama shouldn’t have the right to appoint the next member of the SCOTUS. Republicans will argue that instead, it should be left to the “incoming and not the incumbent” (which makes some sense, and makes absolutely no fucking sense at the same time).
Unfortunately, Congressional Democrats are well-versed in the art of bullshit-politics and may have screwed themselves a bit here. As shown below, Chuck Schumer, a key figure in the Democratic Party stated back in 2008 that Bush should not have the constitutional authority to appoint the next member of the Supreme Court due to his lame duck status.
I’m not picking any sides here, folks. But the main takeaway should be this:
